We aim for your satisfaction while using our mobile application, however, we have established a set of regulations to guarantee a secure and pleasant experience for all users. This overview provides you with the essential information and, in conjunction with the comprehensive section below, constitutes the agreement between you and the company. Kindly acknowledge that you can access the Application solely upon accepting these Terms of Use and our Privacy Policy.

YOU MATCH THEM (YMT) LTD ("YMT") is a registered company in England and Wales with the registration number 15379890. Our address is 20 Wenlock Road, N1 7GU, London, United Kingdom. Please note that we provide the service as it is and cannot guarantee uninterrupted or error-free service, nor can we guarantee specific results.

Who Can Use the Application?

To proceed, it is essential that you are at least 18 years old and have no record of conviction or current charges related to fraud, assault, violence, sexual misconduct, harassment, or any other offenses. Additionally, you should not be subject to any court orders, police investigations, formal cautions, or similar legal actions pertaining to these matters.

Types of Membership

Guests and members can both use the Application for free, but certain features are exclusive to members who have purchased a valid subscription package. The most significant feature that is only accessible to subscribers is the ability to be matched with other members and to communicate with them through the Application's email and messaging systems.

Auto Renewal

When subscribing, the default setting is for automatic renewal on a regular basis. You have the option to cancel this at any time (as long as it is done no later than 24 hours before a payment is due). Please refer to section 9 below.

Safety

Online dating is intended to be an enjoyable and secure endeavour. Our utmost priority is to verify the authenticity of our users, yet it is crucial for you to assume responsibility for your personal safety. Specifically, we would like to emphasise the importance of the following guidance:

You may Terminate your membership whenever it suits you.

Always adhere to our rules without exception. Inform us immediately if you observe any other user on the platform who is behaving inappropriately or not following these guidelines.

You are strictly prohibited from utilising the Application in any manner that may violate any applicable laws, regulations, or codes of conduct. It is imperative that you refrain from incorporating any false, deceptive, offensive, or sexually explicit content within your profile or personal information. Additionally, you must not include or endeavour to include any contact details, such as your surname, in your display name, city, occupation or brief intro. Furthermore, it is strictly forbidden to indicate your subscription status or login credentials in your profile. The Application must not be used, or attempted to be used, for any commercial purposes. It is essential that you only employ payment methods that you are legally entitled to use. Moreover, any material that is subject to copyright restrictions must not be utilised. Lastly, you must not include or attempt to include any links to external websites.

User Generated Content and Information

YMT does not act as the publisher of user-generated content. Therefore, it is solely your responsibility to determine the information you include in your profile or any communication with other users. Please keep in mind that publicly visible information is exactly that - visible to the public!

Rest assured that we will never disclose any of your personal details to another user. We have the right to modify or remove any part of your profile at our discretion. With your consent, we may utilise all or a portion of your profile to promote the service as we deem appropriate.

If you’re a subscriber, we will only show the following information to other users on the platform:

We do not verify the accuracy of any information included in a user's profile, so it is important to exercise caution and independently validate before meeting someone in person or sharing your contact details with them.

We make every effort to promptly remove any offensive or inappropriate content once we become aware of it. If you come across anything we may have missed, please inform us.

YMT Content

All logos, graphics, images, and other visual elements displayed in the Application are the intellectual property of either us or our partners. Therefore, it is strictly prohibited to utilise them for any purpose beyond the intended scope of the Application. Furthermore, you are not permitted to incorporate our Application, either entirely or partially, into any other Application without obtaining our explicit written consent.

Full Terms of Use of You Match Them (YMT)

Please read these Terms carefully. By registering as a Member or Subscriber and ticking the boxes confirming "I confirm that I'm over 18 years old" and "I accept the Terms and Privacy Policy ", which you have read and agree to and each time you use the Services (whether or not you register as a Member or Subscriber), you agree to be bound by these Terms. If you do not accept them in full, you must not register as a Member or Subscriber or use the Services.

We reserve the right to modify these Terms or the Privacy Policy at any time by posting an updated version in our Application. However, if any significant changes are made, we will notify you upon your next login. If you continue to use our Services after the revised Terms or Privacy Policy have been published on the Application, you will be bound by them.

1. Information About Us

The Application is operated by YOU MATCH THEM (YMT) LTD, also known as YMT. Other definitions used in these Terms can be found at the end of the Terms in section 16. YMT is a company based in the United Kingdom, with a postal address at 20 Wenlock Road, N1 7GU, London, United Kingdom. You can reach us at [email protected]. Our company registration number is 15379890.

2. Eligibility to Use the Application and the Services

The Services provided are designed for adult individuals to engage in online communication with one another. In order to become a Member, Subscriber, or User, you must be at least 18 years old.

If you are currently married or in a committed partnership or if you are married (and not legally separated) or in a partnership and are seeking an affair or romantic relationship (whether it be casual, short-term, or long-term), you are not eligible to utilise the Services for the purposes of finding a date, but only to help match other potential dates as a basic user.

If you have been charged with or convicted of any offense related to fraud, assault, violence, sexual misconduct, or harassment, or if you are currently under investigation by the police, subject to a court order, formal caution, or similar circumstances, you are prohibited from using the Services.

Using the Application or the Services for any commercial purposes is strictly prohibited.

Please note that we reserve the right to reject any application to become a Member or Subscriber. Your membership or subscription will only be confirmed upon receiving an email or push notification confirmation from us, and we retain the right to revoke such membership or subscription at any point at our sole discretion.

3. Membership and Subscriptions

You have the option to delete your profile or terminate your subscription at any given time. For further information on cancellation and termination, please refer to sections 9 and 10 below.

In the event that you have an automatic renewal agreement in place and choose not to cancel your subscription, it will be automatically renewed before it expires. The renewal process may occur up to 24 hours prior to the expiration of your current subscription. To avoid automatic renewal, we recommend cancelling at least 48 hours before the expiry date.

Please be aware that if you have not logged into the service for 12 months or longer, your automatic renewal agreement may be cancelled by us without prior notice. In such cases, any applicable discounts will be forfeited.

4. Safety and Security

Our team of experts thoroughly examines all new User profiles (as well as any updates made to them) to ensure that there is no inappropriate content present. Additionally, we make every effort to identify and remove potential scammers from our Application. However, it is important to note that we cannot verify the identity of Users or guarantee the accuracy of User Content. Therefore, it is not advisable to assume that any User Content is accurate or that another User is who they claim to be. It is your responsibility to thoroughly investigate User Content before taking any action based on it. We cannot be held liable for false or misleading statements made by other Users.

When making arrangements to meet someone through our Services, it is crucial that you take appropriate precautions. Any meetings that take place are done solely at your own risk.

You are solely responsible for ensuring that your interactions with other Users are lawful.

If any third parties, whether fraudulent or not, use your identification information or account, you are accountable for their actions or omissions. By agreeing to these terms, you agree to indemnify us against any claims of this nature.

In the event that your identity is used by someone else, we will not be held liable.

If you suspect any breach of security, such as the loss, theft, misuse, or unauthorised disclosure or use of your username or password (if applicable), it is imperative that you notify us immediately. In such cases, you should promptly change your password if one has been created.

While we cannot control the actions of Users who decide to meet in person, we encourage you to report any behaviour that may reasonably pose a threat to other Users by emailing us at [email protected]

Any reports received will be handled confidentially and investigated by a senior member of our customer support team. If deemed necessary, we may choose to issue a warning to the other User or suspend/delete their profile, at our discretion. In the event of a serious incident, such as a physical attack or suspicion of a User going missing after meeting someone through our Services, we strongly advise you to immediately contact the police and inform our customer support team. Please note that we do not intervene in disputes between Users nor provide arbitration or settlement services for any arising disputes.

5. Your Obligations in Agreeing to Use the Application and the Services

You are required to adhere to the following guidelines while using our Services:

  1. You must not violate any applicable laws, regulations, or codes of conduct.
  2. It is prohibited to publish or send any User Content or communications to us that are false or misleading. You must ensure that your User Content remains accurate and truthful. Additionally, the content must not be sexually explicit, sexually suggestive, vulgar, indecent, obscene, racist, homophobic, xenophobic, abusive, unlawful, deceitful, invasive of someone's privacy, offensive, harmful, violent, threatening, harassing, defamatory, or infringing upon the intellectual property or other rights of third parties. Furthermore, you must not encourage or assist in any of the aforementioned activities.
  3. You must not publish any content, including photos, that indirectly or directly alludes to child pornography or attempts to solicit communication with or on behalf of any individual under the age of 18.
  4. It is strictly prohibited to disclose any personally identifiable information or contact details in your profile or any communication made through the Application to a User who has not previously contacted you. This includes, but is not limited to, your last name, postal or email address, telephone number, or any other website address where such information can be found.
  5. Do not share or provide any third party with any username(s), password(s), activation code(s), or similar information assigned to Users, nor utilise them for any purpose other than authentication for the Services.
  6. Please refrain from sharing email addresses of other individuals with us or distributing any User Content that mentions or involves other individuals without obtaining their prior consent.
  7. It is prohibited to publish or transmit any User Content that includes links to illegal third-party websites or websites that contain inappropriate content.
  8. The Services should not be utilised for any commercial, professional, or non-private intentions, which encompass activities such as advertising, canvassing, soliciting, trading, or engaging in prostitution.
  9. The utilisation of the Services for junk mail, spam, pyramid or similar fraudulent schemes is strictly prohibited.
  10. It is imperative that you refrain from engaging in any activities that could potentially disrupt the Services. This includes but is not limited to the utilisation of worms, viruses, software bombs, or mass mailings.
  11. Unauthorised access to any part of the Services or the equipment used to provide the Services is strictly prohibited.
  12. The utilisation of the Services for the purpose of harassing any other Member or attempting to reach out to a Member who explicitly requests the cessation of contact is strictly prohibited. To ensure your comfort and privacy, you can choose to block contact from other Members by selecting the suitable option in the chat or messaging page.
  13. It is strictly prohibited to assume the identity of any individual or organisation.
  14. You are strictly prohibited from utilising the Services for any purposes other than those explicitly stated in these Terms.

Please be aware that you are obligated to adhere to all guidelines and requirements outlined in our Application, as well as any reasonable requests or instructions provided by us in relation to the Services. It is essential that you ensure the accuracy and currency of all contact and payment information (such as postal and email addresses, credit card numbers) that you provide. If you come across any inappropriate behaviour in connection with the Services, including the posting of copyrighted material by another User, please notify us immediately in writing. To report any instances of inappropriate behaviour or suspicious profiles, please email our customer support team at [email protected]

6. User Content

YMT solely serves as a platform for Members to share and disseminate their personal information, and does not assume the role of a publisher for User Content. It is incumbent upon you to determine the information you wish to publish or transmit as User Content, which will be accessible to other Users or individuals on the Internet. YMT shall not be held accountable for any unauthorised use of such User Content by other Users or third parties. Unless explicitly stated in the Privacy Policy , we will not reveal any personal information provided by you, unless it is publicly visible on your profile, without obtaining your prior consent.

YMT retains the authority to exercise editorial control over profile and picture content, however, it assumes no responsibility for User Content (including pictures) or other activities of Users that may infringe upon the rights of other Users or third parties.

YMT does not verify the accuracy or truthfulness of any information published by Users. Therefore, it is advisable for you to conduct your own independent investigations to verify the accuracy of User Content published or sent by other Users and exercise caution when interacting with other Users (refer to section 4 “Safety and Security” above).

We kindly request Users to inform us of any inappropriate User Content. You acknowledge that such notifications may occur and that we may take appropriate actions as outlined in these Terms if the information pertains to User Content published or sent by you.

We retain the authority to decline or temporarily halt, edit, or delete any profile or User Content, in whole or in part, on the Application and the Services for any reason. In the event that we take such action, we will not engage in any correspondence with you regarding the appropriateness of the User Content.

We hold no liability for the removal or inability to retain your User Content, which includes profile information and pictures. Additionally, it is your responsibility to ensure the preservation of any messages you desire to keep.

We retain the authority to permanently erase messages and other User Content. YMT cannot ensure the removal or deletion of offensive or inappropriate material from the Application in every instance, but our failure to do so in a specific case will not impede our ability to remove or delete similar material in future cases.

7. Proprietary Information and Content

The Application and the Services consist of information and content, including marks, logos, graphics, images, photographs, animation, videos, text, and software, which are the intellectual property of our partners, other Users, and us. Your right to use this information or content is strictly limited to accessing, downloading, printing, and reproducing it for your personal, private, and non-commercial use of the Services within the boundaries of these Terms. Without our prior written consent, you are prohibited from retrieving, displaying, modifying, copying, printing, selling, downloading, hiring, or reverse engineering (except as permitted by applicable law) such content. Furthermore, you are not allowed to incorporate our Application, either partially or entirely, into another external web or mobile application without our prior written consent.

Subject to the terms outlined in the Privacy Policy and any specific permissions granted by you, we are granted a license to utilise your User Content. This includes material that you publish on the Application or send to other Members, as necessary for the provision of our Services. The granted license allows us to perform the following actions:

  1. Making your profile visible to other Users of YMT.
  2. Publishing your profile on the You Match Them (YMT) web or mobile application and marketing mails.
  3. Publishing your profile on sites operated by our media partners as part of their promotion of our Services.
  4. Making your profile visible to other Users within dating service specific emails or messages, such as new match notifications.
  5. Utilising such Content in connection with our business-to-business marketing activities.

Copying or utilising any User Content from other Users is strictly prohibited, unless it is absolutely necessary for your personal, private, and non-commercial use of the Services as outlined in these Terms. It is also prohibited to publish or share any material on the Application or through the Services that belongs to a third party without obtaining proper permission. If you come across any material that you believe belongs to a third party and has been posted or shared by another User, please notify us immediately. This includes various forms of content such as photographs, images, and text.

8. Performance of and changes to the Application and the Services

YMT provides the Services to you on an "as is" basis. We cannot guarantee that our Services will be uninterrupted or error-free, nor can we guarantee specific results. However, if faults do occur, we will make reasonable efforts to rectify them. In order to carry out necessary repairs, maintenance, improvements, or for other technical reasons, we may suspend the Services at any time without prior notice. However, we will strive to minimise any disruption by scheduling these suspensions between 8 p.m. and 8 a.m. Please note that we reserve the right to make changes to the Services, as long as these changes do not significantly impact the quality of the Services provided.

9. Right to Cancel

To cancel your order for the Services, use the "Cancel My Account" option on your profile page. Please note that this will not cancel any active paid subscriptions. To cancel a paid subscription, go to your phone's settings, find the "Subscriptions" option, select the subscription(s) you wish to cancel, and confirm the cancellation.

10. Termination

You may terminate your registration with us at any time by either canceling your account through your profile page or requesting the removal of your profile from the application via email at [email protected]. We will process your request as soon as reasonably possible.

To cancel the automatic renewal of your subscription, go to your phone's settings, find the "Subscriptions" option, select the subscription you wish to cancel, and confirm. Please do this at least 24 hours before the renewal date to avoid any charges. Note that canceling automatic renewal may affect your subscriber benefits.

We reserve the right to suspend or terminate your registration at any time, effective immediately and without notice, if we believe you have seriously violated this Agreement or if any User Content you publish or send is deemed harmful to our business or other Users.

Alternatively, we may terminate your registration with a seven-day notice via email. In that case, you will receive an email notification regarding any suspension or termination of your registration. After receiving such notification, you are prohibited from re-registering or using our Services unless we inform you that the suspension has been lifted.

Termination does not affect any accrued rights of either party as outlined in this Agreement.

PLEASE NOTE:

It is imperative that you cancel any auto-renewal agreement at least 48 hours prior to the upcoming payment date.

11. Third Party Websites

In our Application, we may offer links to third party websites, either by us or by third parties. It is important to note that you use these links at your own risk. We do not conduct reviews of these websites, nor do we endorse or recommend them. Additionally, we are not liable for the content found on these sites or any goods or services offered on them. If you come across a third-party website during a search on our Application that would violate any applicable law, it is imperative that you cease using that website immediately.

12. Limitation of Liability

This provision, Section 12, and any other clause that excludes or restricts our liability, applies to our directors, officers, employees, subcontractors, and agents. These individuals, including us, may enforce this clause under the Contracts (Rights of Third Parties) Act 1999. However, it is important to note that nothing in this Agreement limits or excludes our liability for negligence causing death or personal injury, fraudulent misrepresentation, or anything that cannot be legally excluded or limited.

Before incurring any costs to remedy a matter for which we are liable, you must provide us with a reasonable opportunity to address the issue. Failure to do so will result in us having no liability to you for that matter.

We shall not be held responsible for any loss or damage incurred by you, provided that you are the cause or contribute to such loss or damage through your own actions or omissions. This may include instances where you fail to comply with the terms outlined.

Our liability, including cases of our own negligence, in relation to the Services for any single event or a series of related events, is limited to twice the total fees you have paid within the 3 months preceding the event(s) in question.

Under no circumstances, including cases of our own negligence, shall we be held liable for any indirect losses (such as loss of profits, contracts, or business), even if we have been informed of or should have been aware of the possibility of such losses.

We shall not be held responsible for any inability or delay in fulfilling our obligations under this Agreement, if such inability or delay is a result of circumstances beyond our control, including acts or omissions of telecommunications service providers or any faults or failures in their networks and equipment.

13. Indemnity

You are responsible for compensating us (including our directors, officers, employees, subcontractors, agents, and affiliated companies) for any third-party claims and liabilities (including reasonable legal fees we incur) that arise from your violation of this Agreement and/or your utilisation of the Application and Services. This includes any claims or liabilities resulting from your publication or communication of any content or information that infringes upon the intellectual property rights of, or defames, slanders, or invades the privacy of, any third party.

14. General

The headings included in this Agreement are solely for informational purposes and do not impact the interpretation of the Terms or the Agreement itself.

This Agreement, which encompasses the Privacy Policy, serves as the complete and comprehensive agreement between you and us regarding the Services.

These Terms are specific to you and cannot be transferred or assigned to any other individual without obtaining our prior written consent. However, we reserve the right to assign all or a portion of our rights or obligations under this Agreement at any time.

The fact that we do not exercise or enforce any right or provision of this Agreement does not imply a waiver of such right.

In the event that any part of this Agreement is deemed invalid or unenforceable for any reason, the remaining provisions shall remain in full force.

Unless expressly stated otherwise in this Agreement, individuals who are not parties to this Agreement have no rights under the Contracts (Rights of Third Parties) Act 1999.

15. Dispute Resolution

We will make every effort to promptly and effectively address any conflicts with you. However, in the event that either party deems it necessary to initiate legal action, this Agreement is subject to English law and all disputes must be exclusively resolved by the English courts.

16. Definitions Used in the Terms and the Privacy Policy

"Agreement" means the agreement for the provision of the Services between you and You Match Them (YMT) LTD that will be formed when you accept these Terms, and which will include these Terms, the Privacy Policy and any other agreed terms;

"Member" means a registered user of the Services with access only to the free elements of the Application;

"Privacy Policy" means the Privacy Policy governing the use of any personal information you disclose to us when you register as a Member and use the Services;

"Application" means the You Match Them (YMT) mobile or web application at www.youmatchthem.com or such other website as we may use to provide the Services from time to time;

"Services" means the services made available by You Match Them (YMT) LTD to users of the Application (primarily being an online mechanism for Users to find and communicate with other Users);

"Subscriber" means a registered user of the Services who has paid for full access to the free and paid for elements of the Application and the Services;

"Terms" means these terms and conditions of use;

"User" means any person who uses the Services, whether such Services are paid for or not;

"User Content" means any and all information published by Users on the Application, or sent by Users to other Users using the channels provided by You Match Them (YMT) LTD as part of the Services (including profiles, messages and photographs).
